MIAMI -- The 8-year-old boy who was expelled last November for bringing a toy gun to Pembroke Pines Charter School can return to class as soon as Wednesday, Broward County schools Superintendent Jim Notter said Tuesday.

Samuel Burgos was 7 when he brought a clear plastic toy gun in his backpack after playing a neighborhood game of army the day before…

But under the Broward County district's code of conduct, which is based on the state's zero-tolerance campaign, anybody who brings a weapon that is capable of expelling something is subject to a year's expulsion… 

At Tuesday's hearing, Notter recommended the expulsion be taken off Samuel's record.
